Wilber Rafael Garces Perez, 28, was released from Dell Seton Medical Center at about 4:30 p.m. Sunday and transferred to ICE custody, attorney Kate Lincoln-Goldfinch told the American-Statesman. As of Sunday evening, his family did not know where he was being held, she said.

Garces Perez’s wife, whom Lincoln-Goldfinch identified only as Elizdar, retained the attorney to represent him in his immigration case. Lincoln-Goldfinch said Garces Perez has no criminal history and has lived in Austin for about two years.

Elizdar arrived at the hospital and later was joined by Lincoln-Goldfinch after first visiting the scene of the shooting, the attorney said. Hospital staff told them Garces Perez was not there and asked them to leave the property, she said.

About two hours later, after Mayor Kirk Watson became involved in trying to help the family obtain information, a hospital attorney called Lincoln-Goldfinch and told her that Garces Perez had been released into ICE custody, she said.

The family was not given details about his medical condition, Lincoln-Goldfinch said.

Garces Perez suffered a gunshot wound to the torso and was initially taken to the hospital in serious but stable condition, according to Austin-Travis County EMS Chief Robert Luckritz.

The shooting occurred around 12:56 p.m. near Anderson Square and Research Boulevard. Austin police said their officers were not involved in the shooting and that a foot pursuit preceded it, according to Police Chief Lisa Davis.

The U.S. Department of Homeland Security did not immediately respond to a request for comment Sunday.

It looks like an abduction, they have no identification, they are masked, the van is unmarked etc ... It certainly looks like they're just kidnapping this woman.
