Papers, please. Surly thread of deportation cruelty dominance

Pretty incredible and shocking news stories coming out with the increased push and emphasis on immigration. I figured surly could use a NEWS thread to collect the happenings, and they are pretty newsworthy if you're a Texan.

To kick us off, Alice ISD is now circulating a letter advising parents to make sure their children have their paperwork on them at all times, as ICE is stopping school busses to check for illegal 4th graders

https://www.texastribune.org/2025/02/05/alice-texas-buses-students-citizenship-border-patrol/

Gonna be a long way down this news hole, I fear.

I have heard of people carrying photos of immigration papers on their phones, with the intent that they’ll show them to LE if they get stopped.

I’m not a criminal lawyer, but that seems like a bad idea. IIRC, LE can’t force you to provide your password for your phone. But I worry that handing it over to a cop unlocked could be construed as consent to search. So it seems to me that carrying a paper copy is the safer option.

Any crim lawyers on here that can provide insight?

Not a criminal lawyer, but yes.

And your thumbprint or face ID to unlock isn't protected by the 4th Amendment either, only a password is, so make sure you manually lock out any biometric unlocking feature before LEO encounters.

This is true if you are a citizen - if you are illegal you have no rights get into the bus. I am a lawyer, pm me and i will direct you to my credentials on facebook.

Repeated for emphasis.  My phone allows access to my email, which in turn means client information.  Thus, I cannot and will not allow law enforcement to access it, so I do NOT enable biometric unlocking.  Password only.  And among the attorneys here, the understanding is that if law enforcement takes anyone's phone because they won't provide the password, so be it.  Surrender the phone, and we'll buy you a new one.  But we cannot and will not voluntarily grant access to client information, ever.

Of course, my wife and I are also guardians of a young refugee, here on a valid green card.  And we've had to have the conversation with him about having his actual green card and TDL on him, but if he is nabbed/interrogated by ICE, his response should be 1) I am here on a valid green card, and 2) if you have any further questions, speak to my attorney (me).

And yes, we have to have that conversation, as at least one student at his school has already been nabbed in a sweep.

protip if you DO use biometrics - most phones have a "secure lock" feature where you can click the lock button 5 times and it'll require a password or passcode input. Rebooting the phone does the same thing too, and still is compliant with the police's request and is not destructive towards any potential """evidence""" they'd want to pin on you

Nice! I knew rebooting did that, but this makes so much more sense and it's practically instantaneous.

Palestinian DOES NOT MEAN muslim. Ya know there are muslim israelis as well.

I do.

However, literally no one is going to interpret a image of a person in a yarmulke as a Palestinian.  In further consideration, I think the head scarf is probably Jewish as well.   But, that's not important.

It wasn't a gotcha, it was just straight confusion.

sorry for the derail.  carry on please.

A small addendum - on iPhones it's hold the down volume and lock buttons for a couple seconds. This puts you into the "SOS" mode, which you can just cancel out of, but it does not accept faceID or touchID to unlock the phone. On android there's a "lockdown" mode that requires the device PIN or password to unlock.

The click the side button five times thing was for like iPhone 8 and earlier, so probably not useful info anymore lol

I'm rocking an iPhone 13 and clicking the lock button 5 times does the trick

What's the point of having immigration policy and enforcement if people can just sneak into the country or overstay their visa and.....nothing ever happens.

FYI, checking FMMs/Residency cards is SOP in that country just south of us. And they will throw your ass in a shitty jail cell until they get around to physically deporting you.

I saw this floating around Reddit

Quote

"We have received information that U.S. Border Patrol agents may be boarding school buses at highway checkpoints in and out of the Valley to question students about their citizenship status.”

Are they just talking about the normal border patrol spots that exist in South Texas. Or do they have some other information they are talking about, the letter is actually quite vague and not sure the superintendent doesn’t just spell out exactly who told them what.

What are you on about here? We detain and deport hundreds of thousands of illegal immigrants every year. The only difference now is that ICE is boarding fucking school buses to shake down children. You know, the segment of the population that traditionally caries around fucking ID on them.

Cool, just let us know what the appropriate age range is to check for visas/residency.

Maybe it's all from the same source, but this was also reported on the local news this morning. I don't know the answer to your exact question though because my wife started yelling at the TV when she heard it so I missed half of the segment.

Is this actually happening, or is it just some entities saying it could possibly happen?

All I’ve read online are warnings by a school district that it could happen at the border checkpoints.

If it is a real occurrence then that is certainly a shitty tactic.

Yeah I think we need a link to a news article.  I wouldn't be surprised, but I've got enough shit to get wound up about based on the interwebs.

What’s the best advice for dealing with LEO / ICE if they approach and start asking questions? Is it better to say “I’m a US citizen,” give your name, and show a paper copy of a passport? At what point should you clam up and demand a lawyer?

Federal agents went door-to-door at a Denver apartment complex before dawn Wednesday, banging on doors and demanding residents show identification.

Residents of the Cedar Run Apartments at 888 S. Onieda St. — just one of the locations in metro Denver targeted by Wednesday’s large-scale immigration enforcement operation — texted warnings to each other as masked officers flooded the area around 6 a.m., later loading zip-tied detainees onto a large bus outside the complex.

Hannah Strickline answered her door at Cedar Run to find “six heavily armed officers demanding ID,” she said. After she provided her identification, she told The Denver Post, they asked which of her neighbors might be undocumented.

“It’s insulting and infuriating because I would never snitch on my neighbors,” said Strickline, who’s a member of a tenants’ union organized at Cedar Run. “They have every right to be here. And I would never want to put anyone through that sort of stress.”

Crystal Villa, another Cedar Run resident of three years, said federal agents woke her up around 6 a.m. She showed a reporter Ring doorbell footage in which a man wearing a Homeland Security Investigations vest asked if she had drugs, if she was with anyone, if the agent could come into her apartment and if she spoke English.

She was born and raised in Colorado, Villa said while still dressed in her pajamas.

Villa had just purchased the Ring camera after hearing about the potential for ICE raids, she said.

“I was shocked,” she said of the early morning encounter. “This is crazy.”

Strickline said the Cedar Run is about 70% Spanish-speaking residents, mostly families with young kids. A playground behind the building was empty Wednesday as officers worked.

“People are scared,” she said. “And people who aren’t even undocumented are scared. We have dozens of armed officers banging on all doors, like we are all criminals. And no one wants that in their homes.”

Robert Iron Shield, a Native American from the Standing Rock Sioux tribe, also awoke around 6 a.m. to loud banging on his door from federal agents. He presented his ID, passport and tribal documents and began live-streaming.

“We’re falling to the way of Nazi Germany,” he said of the raids.

It could happen. Just like you can take some iodine pills to protect from a nuclear fallout. It hasn’t happened yet but here’s what you do if it happens.

I grew up in a world where if you depicted such a scene in a book/movie/TV, we'd all -- ALL -- shake our heads and think "man, what a shitty authoritarian country.  Must be the USSR or Nazi Germany."

Today, that thing actually happens.  And it's the USA.  Fucking amazing.

I tried that coming back across the border from Matamoros during Spring Break '87 when the agent asked if aI was an American citizen.

Let's just say I wouldn't advise it ... lesson learned.

I mean, I linked a news article to start the thread. It was updated this morning with a statement from CBP saying they would "never target school busses and children", which rings hollow when they also updated their guidelines to no longer explicitly deny entering schools, churches, and hospitals to deport people.

if it ever actually happens it's worth revisiting.  otherwise just more clickbait.
