Nov 14 (Reuters) - A divided federal appeals court affirmed the dismissal of a Texas student's lawsuit alleging he was bullied for being white and supporting Republican President-elect Donald Trump, prompting a conservative judge seen as a potential U.S. Supreme Court nominee to dissent and deplore "racism against whites."

The New Orleans-based 5th U.S. Circuit Court of Appeals split 9-9, opens new tab on Wednesday on whether to revive the student's lawsuit against a school district in Austin, Texas, resulting in a lower-court judge's dismissal of the case being upheld.

The student, referred to only as B.W., had sued Austin Independent School District in 2020, alleging that from the 8th to 10th grades, he was "ostracized" and subjected to verbal and physical abuse for being a Trump supporter, white and Christian.

B.W., who said he sometimes wore a "Make America Great Again" hat, alleged he was harassed for being a racist, anti-feminist, and anti-gay, which he denied; that a teacher called him "Whitey;" and that a fellow student created a meme of him as a hooded Ku Klux Klansman.

He accused the school district of acting with deliberate indifference to the bullying, in violation of Title VI of the Civil Rights Act of 1964, which bars racial discrimination in education programs that receive federal funding.

In January 2023, a three-judge 5th Circuit panel upheld, opens new tab a lower-court's dismissal of the case, saying most of the incidents concerned his ideological beliefs, which could not be the basis of a racial discrimination claim under Title VI.

The full 5th Circuit, one of the nation's most conservative courts, then decided to rehear the case. But a tied vote led to an affirmance again, with three judges appointed by Republican presidents joining with six Democratic appointees to rule against the student.

Nine Republican-appointed judges, including all six of Trump's 5th Circuit appointees, would have allowed the case to move forward, saying his allegations "plausibly amount to severe, pervasive, and objectively offensive racial harassment," even if additional motivations for the bullying existed.

The judges included U.S. Circuit Judge James Ho, a Trump appointee who was on the president-elect's public Supreme Court short-list during his first term and is viewed as a potential candidate should a vacancy emerge in Trump's second term.

Ho, in an opinion joined by fellow Trump appointee U.S. Circuit Judge Kyle Duncan, wrote that the student was "harassed on multiple occasions for multiple reasons — but being white was absolutely one of them."

"It's racist to characterize whites as racist," Ho wrote. "Because it’s racist to attach any negative trait to a group of people based on their race. And it's no less racist just because the victimized racial group is white."

He said it was "not surprising that more institutions increasingly believe that they have cultural permission to tolerate (if not encourage) racism against whites, under the guise of promoting diversity."

"Federal laws like Title VI prohibit discrimination on the basis of race," Ho wrote. "So it may be politically correct in certain circles to discriminate against whites. But politically correct does not mean legally correct."

Martin Cirkiel, a lawyer for the student, said he planned to pursue an appeal at the U.S. Supreme Court, citing the "importance of protecting kids at school, regardless of their race, religion nationality or political beliefs."

A lawyer for the school district did not respond to a request for comment.

The case is B.W. v. Austin Independent School District, 5th U.S. Circuit Court of Appeals, No. 22-50158.
