Getting on Disability/SS

Recommended Posts

So I have a friend that is 33 y/o and just had a massive stroke last month. It was not caused by drug/lifestyle and was sever.

Hes doing better but probably won’t ever have good enough vision to drive and hasn’t been able to work since this happened. He’s blown thru his savings and is being enticed by some scummy lawyers to give them his case and they will give him payments until his disability clears which could take a long time since he’s so young.

Any advice you guys might have with the best way to go?

He can apply himself. He doesn’t need a lawyer. A specialist you pay make make it easier or faster but the most crucial aspect is a doctor that will support the claim.

That’s just it, they are calling him and freaking him out. He’s looking at his car being repo’d but I told him fuck it you can’t drive anyway

theyre saying that since he’s so young there will be multiple hearings and he won’t get paid for up to 2 yrs.

Not true - I have a buddy who has been diagnosed with a form of Alzheimer's and he's basically 50.  Did not take 2 years - Did not take a year.

He needs to file now - If there is a problem he can always hire a lawyer later.

Get to take his medical records and get to the local SS office ASAP and start the process...he can worry about lawyers if it ever gets to that point.

With this type of event, there is a three month "waiting period" to see how much recovery he will have, so he will definitely have to hold out for 3 months. Then, if after the three months he is granted benefits it will still be another two months before benefits start. He will get a "lump sum" paying from the date of onset, but he still has to finance himself until he gets benefits. This is true with, or without a lawyer, and the lawyer will probably take a good chunk of the lump sum, plus possibly more. The application papers look intimidating, but are pretty straight forward. Just get the papers and answer the questions to the best of your ability. Nobody goes to prison for making an honest mistake on the application. Shoot me a PM if you want.

My wife is on disability and so are a few others that I know and they all had a hard time getting approved even though they had multiple doctors that said they were disabled.

My wife finally hired an attorney and suddenly they approved her with no further proof. The law limits the attorney to 25% of any back pay you are due.

It took my wife 2 years from the date she applied before she was approved. They drag their feet at every step in the hope that you will give up and go away.

Lawyers typically want you to apply yourself anyway because the lawyer can only get paid for getting you past benefits, which requires you getting denied first so they can appeal that determination.
