WATERTOWN, New York — A judge handed down 10 years' probation last week to a former New York school bus driver after he admitted to raping a 14-year-old girl.

Shane Piche, 26, will be registered as a Level 1 sex offender, according to the Waterford Daily Times. The judge reportedly said because he had no prior arrests and there was one victim, the sentence was appropriate.

Level 1 is considered the lowest risk level out of three, and Piche will not be included in online sex offender databases.

He pleaded guilty in February to raping a 14-year-old girl who he met through his job as a bus driver with the city's school district, the newspaper reports.

Piche also was charged with unlawfully dealing with a child and endangering the welfare of a child after he allegedly gave the girl alcohol.

The Times reports Piche is required to pay $375 in court fees and surcharges, plus a $1,000 special sex offender registration fee.

Lock them both (rapist and judge) in a safe and drop them in the East River.

That would seem like a waste of gas with Lake Ontario right there.  Since this is the small town, redneck part of the state, I wonder if the perpetrator is related to someone with some regional pull.

Please tell me that there is more to this story.

Apparently. it was consensual, but since she was 14 she cannot give consent.(of course)  So 3rd degree rape.

However, both Jefferson County prosecutors and Piche’s lawyer say the punishment fits the crime.

“My client was 25, okay, and he pled to having sex with a person that was at that point 14 years-old. So by definition, she can't consent,” said Eric Swartz, Piche’s attorney. “So that is rape, third (degree). I think what people think is that there's an assault element when they hear that word.”

During sentencing, Judge McClusky noted that Piche had no other prior arrests and there was only one victim.

Swartz says there’s no indication that an attack of any sort happened, but the victim’s age makes Piche’s actions illegal.

“Is it okay to have sex with a teenager? No, it's not. And he pleaded guilty to that and he's suffering the consequences of that," Swarz said.

Jefferson County Assistant District Attorney Patricia Dziuba says Judge McClusky was well within his right to sentence Piche to probation. She says there are other misconceptions about the case.

“This sexual contact occurred between the defendant and the victim away from school property, a good point in time after they met on the school bus when the defendant was driving her bus,” she said. “It was my understanding that there was some contact on social media and then there was a physical meeting and that's when the offense occurred.”

According to the New York State Division of Criminal Justice Services, a Level 1 sex offender is a low risk of repeat offense and not included in any online sex offender databases.

“Getting him onto probation to get sex-offender treatment, our hope is that we can teach him better ways to deal with these issues and maybe educate him about making better choices in the future, as well as keeping him from having access to children at this point which is part of what the probationary period will do.”

Swartz says Piche is still in the Watertown area, working a job earning minimum wage and will never drive a bus again.

In a victim impact statement not read in court, but given to WWNY in Watertown, the victim's mother wrote, "I wish Shane Piche would have received time in jail for the harm he caused to my child. He took something from my daughter she will never get back and has caused her to struggle with depression and anxiety."

Ding ding ding we have a winner.

Follow the money. The judge better been paid well for this because it's the last they're going to get.

If this were a 25 year old woman and a 14 year old boy, it would be posted in lulz and you’d all be tripping over yourselves virtually high fiving him and wonder why she wasn’t driving your bus route back in the day.

Jay Z would say “Everybody ride her, just like a bus route”

They like to shorten it to rape so their audience will immediately imagine a violent act.  It was statutory rape.  That's obviously why he got Level 1 or whatever.  If he committed a violent act upon any female, let alone an underage girl, then I agree with the rest of you.

Nah, after the initial jokes, the reality is it's still a 14 year old child, and a 25 yr old adult in charge of other children.  This won't be the last time that fucker does this,  it's pedophilia.  The judge was 100% in the wrong, and a 14 year old doesn't really have a consensual choice IMO.
