SAN DIEGO - A federal judge ruled on Monday, July 1 that prosecutors can introduce evidence of Rep. Duncan D. Hunter's alleged extramarital affairs in a case in which the Republican congressman is charged with misusing more than $250,000 in campaign funds for personal expenses.

U.S. District Judge Thomas Whelan said prosecutors can submit evidence alleging that Hunter, R-Alpine, used campaign funds to maintain multiple extramarital affairs. The allegation was raised in a motion filed last week by federal prosecutors. Hunter's attorneys argued the evidence would be prejudicial and bias the jury against the congressman.

Whelan did not immediately rule on Hunter's request for dismissal of the case, with the congressman alleging political bias by the U.S. Attorney's Office. Hunter filed a motion last week claiming that U.S. Attorneys Alana Robinson and Emily Allen, who are prosecuting the case, are biased against him -- noting that they attended a 2015 presidential campaign fundraiser in La Jolla for then-Democratic presidential candidate Hillary Clinton.

While Hunter declined to comment, his father -- former longtime Rep. Duncan L. Hunter -- suggested the U.S. Department of Justice should investigate the conduct of Robinson and Allen for violating the Hatch Act, which prevents federal employees from using taxpayer dollars for political or electoral purposes.

According to the U.S. Attorney's Office, Robinson and Allen were at the fundraiser on official business. The elder Hunter argued that a Secret Service email, obtained via a Freedom of Information Act request, shows that's not the case.

"We have the email that came from the Secret Service that came with the FOIA request and the Secret Service email plainly says that they actually came to get a photo opp with their candidate, Hillary Clinton,'' he said. "That's a violation of the Hatch Act. That taints this entire investigation and this entire indictment and so there should be an investigation and we hope that it takes place.''

In addition to allegedly using campaign funds for affairs, Hunter, who represents the state's 50th Congressional District, is accused of using campaign funds to pay for expenses like hotel rooms, vacations and theater tickets.

Hunter has repeatedly maintained his innocence and the insistence that he is being smeared despite his wife, Margaret Hunter, pleading guilty earlier this month to using campaign funds for personal expenses. Margaret Hunter also agreed to work with prosecutors on the case and could eventually testify against her husband.

If convicted, Margaret Hunter faces up to five years in federal custody and fines of up to $250,000.

Hunter's case is expected to go to trial in September. He faces multiple charges including wire fraud, conspiracy and falsifying records.

Hunter was re-elected last November with 51.7% of the vote in his district despite being indicted three months before the election. He was first elected in 2008, succeeding his father, who held the congressional seat for 28 years.

This fuckstick is horrible.  When he was mayor, escondido passed a law to make it illegal to rent to undocumented aliens.  The courts blew it out of course.

Former Escondido Mayor Sam Abed has filed paperwork stating his intent to run for Rep. Duncan Hunter’s Congressional seat next year.

He joins El Cajon Mayor Bill Wells and two other Republican candidates who appear to be positioning themselves for GOP support should Hunter be forced to resign given his current legal problems.

Abed, 67, served as Escondido’s mayor for eight years before being defeated last November by Paul McNamara, a surprising change that shifted the ideological bent of the council, which had been solidly conservative for a decade.

“We are moving with full speed to win that seat and defeat Ammar Campa-Najjar in this election,” Abed said Wednesday. Campa Najjar, a Democrat, ran against Hunter in 2018 and received nearly 49 percent of the vote in the heavily Republican 50th District, which includes Escondido and much of the East County.

Abed said he doesn’t think Hunter will survive his legal problems.

“I’m not going to run against Duncan Hunter,” Abed said. “I have a great respect for his service to our country. However, what he did was unacceptable and I don’t think he’s going to make it and he has compromised the representation of the 750,000 people in the the 50th District.”

Hunter, R-Alpine, is accused of improperly spending $250,000 in campaign dollars on personal expenses. He has pleaded not guilty and is awaiting a criminal trial tentatively set for September in federal court.

Abed said he hopes to have the support of former Rep. Darrell Issa, but it remains possible that Issa may also run for the 50th District seat.

 

Either way, Abed said, it is his goal to keep the 50th District in the Republic ranks and prevent Campa-Najjar from winning. He described Campa-Najjar as a “very socialist liberal.”

“It is our goal to win the district,” Abed said.

Abed at times made national headlines in Escondido with his controversial stances and statements regarding illegal immigration. He said his past accomplishments make him a “perfect fit” for the district where he said immigration is at the top of voters’ minds. He operates a consulting firm.

His argument is that he got into debates about his extramarital affair with his wife, and about when he was going to leave his wife with his mistress.

For those that haven't been keeping score, Darrell Issa has moved into that district (CA50), and intends to run, as is Carl DeMaio, but he's got the gay, so he can't win.

Anmar is still running from the Dem side.  It will be interesting to see if Issa's lebanese ass tries to paint him as a terrorist like Hunter did.

In a 15-minute back and forth with reporters, Hunter invoked a “deep state” conspiracy among “partisan Democrat prosecutors” as the reason why he and his wife, Margaret Hunter, were facing charges of conspiracy to commit wire fraud, falsification of records and aiding and abetting in the prohibited use of campaign contributions.

Hunter, 41, told reporters in San Diego on Wednesday, “I’ve never used my campaign for personal expenditures — ever.”

 

“It’s the U.S. government trying to make you look bad,” he said. “They can make it look however they want to make it look, we all know this.”

Then Hunter said again, “I never used campaign funds for personal purchases — ever.”

In the allocation statement, Hopefully the judge will require hunter to say more than “I made mistakes and I’m sorry.”  When a politician breaks the public trust and has spent the last couple of years calling the charges a sham, it’s time to come clean.

it also creates a public record of him saying exactly what he did wrong when he tries to downplay it in the future.
