Did you read further upthread? I'm saying this is all happening because the legislature isn't legislating. The response is "the legislature can't legislate because it can't legislate" and I responded with a way they could actually legislate it into existence to which the further replies were "LOL BUT THE LEGISLATURE CANT LEGISLATE"

Our problem is Congress. It's forced Executive and Judicial Branches to start legislating from the EO and the Bench. This is our fault for not holding our fucking elected legislative officials accountable and letting them just suck on the teet of american taxpayer dollars for lifetimes with little to no body of work.

Congress is extremely dysfunctional but it's not THE problem here. THE problem is conservative justices lying about what the Constitution says. The nondelegation doctrine they've made up has no basis in text or history and is a fake legal doctrine they invented specifically because it would be impossible to actually comply with even if Congress functioned well.  Even if Congress was functioning well, with this Court they'd simply ignore any amendment that was actually passed and ratified to try to address their bullshit.

this court is literally rewriting statutes congress passed and were signed into law by the executive because it doesn't like the statute, so created out of thin air rules to either gut or invalidate the statute.  congress could be well-functioning and that wouldn't stop this court at all.

It's absurd to say that the Supreme Court broke all on its own and of it's own accord. It was a vehicle used to rule, just like the executive office was used when GWB was in office. 

the GQP is certainly to blame for the rampant abuse of the government and it's ultimate unraveling of functionality - but that ONLY HAPPENED BECAUSE LEGISLATURE STOPPED LEGISLATING

dude the VRA was legislated and passed into law by a well functioning congress.  and congress clearly has the authority under section two of the 15h amendment to do the VRA.  this supreme court gutted it anyway.

Nevermind - fuck it the reason the supreme court is fucked is because the supreme court is fucked. There is no other reason. It didn't happen because of something else, it's actually just a magic problem that appeared out of nowhere and thin air.

The GOP stacked the Supreme Court specifically to invalidate any legislation that Democrats managed to get through Congress.

Why does it have to be one or the other?  Congress is fucked up.   It's filled with a bunch of wackos or checked out long termers  in safe seats due to gerrymandering.  I don't think anyone here disagrees with that.  The Supreme Court is also fucked up and is rendering batshit decisions sounding in Calvin Ball.

The fact of the matter is that the Supreme Court is packed because the Democrats badly misplayed their hand.  

RBG should have retired during Obama's 1st term, and they should have put up a fight for Merrick Garland instead of assuming Hillary would win.

If they nuke the filibuster, they could expand the court. That way the court will always rule for the party in power. It's a whole lot worse than what we used to have, but also a whole lot better than the current court ruling in favor of the party that was just voted out every time.

Which is why Democrats should introduce a bill that limits judicial review for cases that do not involve original jurisdiction as set forth in the Constitution.
